In our experience, most employment disputes can be avoided by taking thoughtful and preventative action before the matter becomes a problem, and we counsel our clients accordingly, often serving the role of in-house counsel for our small to medium sized business clients.
Employment Law Compliance & Litigation Avoidance
We advise our clients regarding their rights and responsibilities under the laws and regulations that regularly impact the employment process, including Title VII and other laws prohibiting workplace discrimination, the Americans with Disabilities Act, the Family and Medical Leave Act, the Fair Labor Standards Act, WARN, and COBRA, as well as various Virginia laws that govern aspects of the employment relationship. We also assist clients in responding to charges of discrimination filed with the Equal Employment Opportunity Commission and local EEO offices as well as charges filed with the United States Department of Labor.
Employment Contracts
We counsel both employers and employees in negotiating and drafting employment contracts, including noncompete agreements and other restrictive covenants. We also counsel our clients on the termination of employment relationships, including severance and separation agreements and releases.
Employment Litigation
We represent both employers and employees in a wide variety of employment litigation including contract disputes, noncompete and other restrictive covenant litigation, discrimination and harassment claims, wage and hour litigation, and claims involving the Family and Medical Leave Act as well as other federal and state statutes.
Labor Negotiation & Labor Disputes
We negotiate labor agreements for employers across the United States and handle a variety of labor disputes, including representing employers before the National Labor Relations Board.
